Advertiser Terms of Service
Version 1.0 · Last updated 28 August 2026 · Effective 28 August 2026
These Advertiser Terms of Service (“Advertiser Terms”) govern your use of OurBestie Ads (the “Ads Portal”) to create, manage and pay for sponsored placements (“Campaigns”) shown in the OurBestie app. By creating an advertiser account or submitting a Campaign, you agree to these Advertiser Terms.
The Ads Portal is operated by SQUARIFY LLC, a limited liability company registered in Wyoming, United States, with its registered office at 30 N Gould St Ste R, Sheridan, WY 82801 (“OurBestie”, “we”, “us”). These Advertiser Terms are supplemental to OurBestie’s general Terms and Conditions and Privacy Policy, which are incorporated by reference. Where the two conflict, these Advertiser Terms prevail on anything to do with advertising.
1. Your advertiser account
To use the Ads Portal you must create an advertiser account with a valid email address and a password. You are responsible for keeping your credentials confidential and for everything done through your account. Tell us as soon as you think someone else has access to it.
You confirm that the information you give us is accurate and that you have the authority to enter into these Advertiser Terms on behalf of the business you represent.
2. Campaign creation and content
You are solely responsible for everything you submit as part of a Campaign, including business names, titles, descriptions, images, logos, opening details, prices and any external links (“Campaign Content”). You represent and warrant that:
- Your Campaign Content is accurate, is not misleading, and does not break any applicable law or regulation;
- You hold all the rights, licences and permissions needed to use and display it;
- It does not infringe anyone else’s intellectual property, privacy or publicity rights;
- It complies with OurBestie’s Community Guidelines;
- Any business, activity, event or experience you promote is real, is open to the people you are promoting it to, and is one you are legally entitled to operate.
We do not accept Campaign Content that promotes illegal activity, adult services, weapons, gambling where it is unlawful, drugs, hate speech or discrimination, or anything else that could put the safety or wellbeing of OurBestie users at risk.
You may promote a sponsored placement only through your own approved Campaign. You may not use any other channel inside the OurBestie app to push people towards it, to solicit bookings, or to redirect them to a Campaign of yours.
3. Campaign review and approval
Every Campaign is reviewed before it goes live. We may approve it, reject it, or ask you to change it, at our sole discretion and for any reason — including content quality, brand safety, and the effect we think it will have on the people using the app.
Approval is not an endorsement of you, of your Campaign Content, or of what you are promoting. We may remove or suspend a Campaign after approval if it turns out to breach these Advertiser Terms, or for any other reason at our discretion.
4. Pricing and payment
What a Campaign costs depends on the cities you choose, how many travellers we see in them, what it costs to reach people there, and how long you run for. The rate is quoted before you commit and is the rate you pay. Rates can change for future Campaigns.
Monthly subscription (the default)
Campaigns are billed as auto-renewing monthly subscriptions unless you choose otherwise. By paying, you authorise us, through Stripe, to charge your payment method every month at the quoted rate until you cancel. The first month is charged at checkout. If your Campaign is rejected at review, the subscription is cancelled and that payment is refunded in full. Renewals fall on the same date each month at the same rate, unless we have given you notice of a price change.
Cancelling. Cancel at any time from the billing portal in your Ads Portal dashboard, or by emailing support@ourbestie.app. Cancellation takes effect at the end of the billing period you have already paid for: the Campaign keeps running until that date and you are not charged again. We do not refund part months.
Paying upfront (optional, three months or more)
For Campaigns of three months or longer you can pay the whole term upfront at a discounted rate. We place an authorisation hold on your card at checkout and only take the money once the Campaign is approved. If it is rejected, the hold is released and you are not charged. Prepaid Campaigns run for the term you committed to and do not auto-renew.
Payments
Payments are processed by Stripe. We never see or store your card details. Paying through the Ads Portal means you also agree to Stripe’s terms.
Refunds
If a Campaign is rejected at review you are not charged — a prepaid hold is released, and a first monthly payment is refunded in full. Once a Campaign is approved and the payment has been taken, refunds are handled case by case; write to us at support@ourbestie.app. Once a Campaign is live you may cancel at any time, but you are responsible for the charges already incurred, and part months are not refunded.
Failed payments
If a recurring payment fails, your Campaign is paused and hidden from the OurBestie app until the payment goes through. Stripe retries on its own schedule. If it recovers the payment, your Campaign goes back up automatically.
5. Campaign duration and performance
A monthly Campaign runs for as long as the subscription is active, and comes out of the app when the subscription is cancelled or a payment fails. A prepaid Campaign runs for the term you committed to.
We do not guarantee any number of views, taps, saves, enquiries or bookings. The figures in the Ads Portal are there to tell you how a Campaign is doing, not to be relied on as exact counts.
Your Campaign appears alongside other content, sponsored and organic, and we do not promise exclusive placement or a particular position in any city or view.
6. Intellectual property
Your Campaign Content stays yours. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce and distribute it in order to run the Ads Portal and show your Campaign in the OurBestie app.
The OurBestie name, logo, trade marks and service marks are ours. You may not use them without our written permission, beyond what is reasonably needed to say that you advertise with us.
7. Data and privacy
We give you aggregated, anonymised figures about how your Campaign performed — views, taps and saves. We do not share personal information about OurBestie users with advertisers. Our Privacy Policy covers how we handle user data.
We collect and process your own advertiser details — name, email address, business name, and the payment data held by Stripe — to run your account, bill you, produce your analytics, and contact you about your Campaigns.
8. Indemnification
You agree to indemnify, defend and hold harmless SQUARIFY LLC and its officers, directors, employees and agents against any claim, liability, damage, loss or expense, including reasonable legal fees, arising out of or related to:
- Your Campaign Content, or any business, activity, event or experience you promote;
- Your breach of these Advertiser Terms;
- Your breach of any applicable law or regulation;
- Any third-party claim connected to your Campaign, including personal injury, damage to property, and intellectual property infringement.
9. Limitation of liability
To the fullest extent the law allows, OurBestie is not liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Ads Portal or any Campaign, including lost revenue, profits, business or data. Our total liability will not exceed what you paid for the Campaign the claim relates to in the twelve months before the claim.
Nothing in these Advertiser Terms limits liability that cannot lawfully be limited.
10. Termination
Either of us may end the advertising relationship at any time. We may suspend or close your advertiser account immediately if you breach these Advertiser Terms. On termination, any live Campaigns may be removed. You remain responsible for payments already owed.
11. Disclaimer of warranties
THE ADS PORTAL AND ALL RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. OURBESTIE DOES NOT WARRANT THAT THE ADS PORTAL WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT DEFECTS WILL BE CORRECTED. OURBESTIE MAKES NO GUARANTEE AS TO THE NUMBER OF VIEWS, TAPS, SAVES OR BOOKINGS ANY CAMPAIGN WILL RECEIVE.
12. Taxes and business customers
Prices quoted in the Ads Portal exclude tax. You are responsible for any sales tax, VAT, GST or other tax that applies in your jurisdiction because of your use of the Ads Portal or your purchase of a Campaign. We collect and remit tax where the law requires us to.
OurBestie is established in Wyoming, United States, and does not charge EU or UK VAT on Campaigns. Where VAT applies it falls under the reverse-charge mechanism and you account for it yourself in your own country, under Articles 44 and 196 of the EU VAT Directive or the UK equivalent. You agree to give us accurate business details, including a VAT identification number where you have one, and to indemnify us for any tax, penalty or interest that arises because you misrepresented your status.
13. Advertiser compliance
You are responsible for making sure your Campaign Content, and any page you link to, comply with every law, regulation and industry standard that applies — including the UK CAP Code, the EU Digital Services Act, the US Federal Trade Commission’s advertising guidance, and local advertising rules wherever your Campaign is shown. Your compliance is not something we can do for you or are responsible for.
14. Force majeure
Neither of us is liable for failing to perform, or for performing late, where the cause is outside our reasonable control — including acts of God, natural disasters, epidemics, war, terrorism, riots, government action, power cuts, internet or telecommunications failures, and cyberattacks. Whoever is affected will make reasonable efforts to limit the impact and get back to normal as soon as they can.
15. Changes to these terms
We may change these Advertiser Terms. We will give you at least 30 days’ notice of material changes, including changes to pricing, by email to the address on your advertiser account. Carrying on with the Ads Portal after they take effect means you accept them. If you do not, you can close your account before that date.
16. Governing law and disputes
These Advertiser Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law rules. Disputes arising out of them will be resolved in the courts of the State of Wyoming, except that either of us may seek injunctive relief from any court that has jurisdiction.
17. General provisions
Severability. If any part of these Advertiser Terms is found to be unenforceable or invalid, it is limited or removed to the smallest extent necessary and the rest stays in force.
Entire agreement. These Advertiser Terms, together with the general Terms and Conditions and Privacy Policy incorporated by reference, are the whole agreement between you and OurBestie on this subject, and replace anything said or written before.
Assignment. You may not assign or transfer your rights or obligations under these Advertiser Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganisation, or sale of all or substantially all of our assets.
Waiver. If either of us does not enforce a right or a provision, that is not a waiver of it.
Notices. We send notices to the email address on your advertiser account. Send notices to us at hello@ourbestie.app. A notice sent by email counts as received when it is sent.
